1. Agreement to Terms

By accessing or using any website, service, or tool provided by Digitari Solutions (“we”, “us”, “our”), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2. Services

Digitari Solutions provides web design, development, local SEO, and related digital services to businesses, primarily in British Columbia, Canada. Specific terms for any project are outlined in a separate written agreement or statement of work.

3. Free Tools & Resources

We offer free tools including the Canadian Directory Submission Tracker. These tools are provided as-is for informational purposes. We make reasonable efforts to keep directory listings accurate but do not guarantee completeness or availability of any third-party directory.

4. Website, Monthly

Website, Monthly is billed at $150/mo. That covers the build of a 7 page website, hosting, SSL, and lead capture forms, and 12 content updates per year.

Billing starts on the day you sign up and recurs monthly on that same date. If a payment fails, we will let you know and your site stays live for seven days while it is sorted out. After that the site is paused rather than removed, and it goes back up as soon as payment clears. We do not delete your site or your files over a missed payment.

You register your own domain and it stays registered in your name. We do not hold your domain. While you are on the plan you give us access to manage its DNS records so we can point them at our hosting and keep the site running, and that access ends when your plan does.

Your domain is always yours. Anything you give us to use on the site, such as your logo, your photos, and your business information, also stays yours.

The design, code, and written copy we create for your site belong to Digitari Solutions until you have paid $1,250 in total in plan fees, before tax, on Website, Monthly or Digitari Presence. On Website, Monthly alone, that is reached with your ninth monthly payment. Once you reach that amount, the design, code, and copy become yours outright, whether or not you stay on a plan.

Stock images, fonts, and other third-party assets we license for your site are licensed to us and do not transfer to you. If you take your site, we will tell you which assets are licensed so you can license them yourself or replace them.

There is no contract and no minimum term. You can cancel at any time without giving notice, and your site stays live through the end of the month you have already paid for. Hosting under the monthly plan ends when the plan ends.

If you cancel before you have paid $1,250 in total, you can buy the site out by paying the difference between what you have paid and $1,250, and it becomes yours. If you do not buy it out, we take the site down at the end of your paid month. Your domain stays yours either way, and we send back anything you gave us to use on the site.

If we ever need to end a plan, we will give you at least 30 days notice, and the site becomes yours at no extra cost, however much you have paid.

When you leave with a site that is yours, we will send you your site files along with written instructions for pointing your domain wherever you want it next. If you have never done that before, work with us and we will help you get it sorted rather than leaving you with a document.

If you signed up for Website, Monthly before October 28, 2026, the ownership terms in place when you signed up still apply to your plan, and your site files are yours as promised then.

Each of the 12 content updates included per year is a request to change existing content on your site, turned around within 2 business days. Unused updates do not roll over from one year to the next.

Additional service pages or service area pages beyond the 7 included pages are $15/mo each. Redesigns and new sections are quoted separately.

5. Intellectual Property

All content on digitarisolutions.com, including text, design, code, and graphics, is the property of Digitari Solutions unless otherwise noted. You may not reproduce, distribute, or create derivative works without written permission.

Code delivered to clients as part of a paid project becomes the client’s property upon receipt of full payment, unless otherwise specified in the project agreement. For Website, Monthly and Digitari Presence, ownership of the site works as set out in section 4.

6. User Conduct

You agree not to use our services or tools to transmit spam, conduct automated scraping, attempt unauthorized access to our systems, or engage in any activity that disrupts or degrades our services.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Digitari Solutions shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or tools. Our total liability for any claim shall not exceed the amount paid by you for the service giving rise to the claim in the preceding three months.

8. Third-Party Services

Our services may integrate with or link to third-party platforms (a hosting provider, Supabase, Resend, Google, Cloudflare, etc.). We are not responsible for the practices, availability, or content of these third parties. Their respective terms and privacy policies apply.

9. Governing Law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.

10. Changes to These Terms

We may update these terms from time to time. When we do, we will update the effective date above. Continued use of our services after changes constitutes acceptance of the updated terms.
